1. Acceptance of Terms

By accessing or using the services provided by Austin Texas Mobile Notary Public (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and clients who request or receive mobile notary services through our website, phone, or in-person appointments.

If you do not agree with any part of these Terms, you should not use our services.


2. Description of Services

Austin Texas Mobile Notary Public provides mobile notary services in Austin, Texas and surrounding areas, including but not limited to:

  • General notarizations
  • Loan signing services
  • Estate planning document notarizations
  • Apostille facilitation (non-governmental processing assistance)
  • I-9 Employment Verification (Authorized Representative only)
  • Document witnessing and identity verification

We travel to agreed-upon locations such as homes, offices, hospitals, and public meeting places.


3. Notary Limitations & Legal Disclaimer

We are not attorneys and do not provide legal advice, legal interpretation, or document drafting services.

By using our services, you acknowledge that:

  • You are responsible for understanding the content of your documents
  • We cannot advise you on which notarial act is required
  • We do not prepare legal documents unless explicitly stated as a non-legal service
  • We will refuse service if a request violates Texas notary laws

For legal guidance, you should consult a licensed attorney.


4. Identification Requirements

All signers must present valid, government-issued photo identification at the time of notarization. Acceptable forms include:

  • State-issued driver’s license
  • U.S. passport
  • State identification card
  • Military ID

Failure to provide proper identification will result in refusal of service, and applicable travel fees may still apply.


5. Client Responsibilities

Clients agree to:

  • Provide complete and accurate information when booking
  • Ensure documents are ready for notarization prior to the appointment
  • Not sign documents in advance unless instructed
  • Be physically present at the scheduled time
  • Ensure all required signers and witnesses are present

We are not responsible for delays caused by incomplete documentation or missing parties.


6. Fees & Payment Terms

Our fees consist of:

  • State-regulated notarial fees (per Texas law)
  • Travel/convenience fees
  • Additional service fees (after-hours, emergency, printing, wait time, etc.)

Payment is due at the time of service unless otherwise agreed in writing.

We accept forms of payment including cash, credit/debit cards, and other electronic methods where available.


7. Cancellation & No-Show Policy

Clients may cancel or reschedule appointments; however:

  • Same-day cancellations may incur a travel fee
  • If the notary has already arrived at the agreed location, the full travel fee applies
  • No-shows or failure to provide required ID or documents may result in charges

We reserve the right to cancel appointments due to safety concerns, legal restrictions, or unforeseen circumstances.


8. Refusal of Service

We reserve the right to refuse notarization if:

  • The signer lacks valid identification
  • The signer appears unwilling, coerced, or not mentally competent
  • The document is incomplete or contains blank sections
  • The request violates Texas notary laws
  • The notary feels unsafe or uncomfortable with the environment

9. Limitation of Liability

Austin Texas Mobile Notary Public is not liable for:

  • The legality, validity, or accuracy of documents
  • Errors in documents provided by the client
  • Delays caused by third parties (courts, government agencies, etc.)
  • Any indirect, incidental, or consequential damages arising from use of our services

Our role is limited strictly to verifying identity and witnessing signatures.


10. Apostille & I-9 Service Disclaimer

For apostille services:
We assist with document preparation and submission guidance but do not guarantee processing times or acceptance by government agencies.

For I-9 Employment Verification:
We act only as an Authorized Representative and are not responsible for employer compliance decisions or document acceptance beyond visual inspection.


11. Privacy Policy

We respect your privacy and take reasonable measures to protect your personal information. Any information collected during scheduling or notarization is used solely for service delivery and record-keeping as required by Texas law.

We do not sell or share your personal data with third parties except as required by law.


12. Website Use

All content on this website is for informational purposes only. Unauthorized use, reproduction, or distribution of any content is prohibited.

We do not guarantee that the website will be error-free or uninterrupted.


13. Governing Law

These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from the use of our services shall be resolved within the appropriate courts located in Travis County, Texas.
